Candidates' consent to the processing of their personal data

Please read and confirm below.

Signium International GmbH Angela Westdorf (hereinafter also referred to as "Signium") is a personnel consultancy firm, active in fields of executive search and leadership consulting. It places suitable candidates for management positions with clients, i.e. potential employers. For this purpose - as in any regular application process - personal data is crucial to verify the suitability of candidates for Signium and its clients.

However, we protect your privacy and your private data. We collect, process and use your personal data exclusively in accordance with the contents of your declared data protection consent, applicable European and German data protection regulations and the following explanations, with which we simultaneously fulfil our statutory duties to provide you with information in accordance with Art. 13 GDPR.

By clicking on "I agree to the processing of my personal data described above, particularly also the aforementioned storage and forwarding" (hereinafter also referred to as "the declaration of consent") and by clicking the "OK" button, you expressly consent to your personal data (hereinafter also referred to as "candidate information"), which you have either transmitted to us yourself or made available to us via channels such as Xing, LinkedIn etc., being processed by us.

In this case, the declaration of consent is valid indefinitely until revoked and is also not bound to the termination of a specific search mandate. Your declaration of consent below gives us permission to remain in contact with you after your successful placement with a client and/or to consider you in future search mandates. If you expressly do not wish us to continue processing your personal data after completion of a specific search mandate to remain in contact with you and have scope to consider you for future searches, you are free to submit a corresponding declaration of revocation under the contact data mentioned under item 1 in which you state that you do not wish your personal data to be processed beyond the time of any successful placement with a client.

Your declaration of consent described above also includes, particularly, the transfer of candidate information to clients (i.e. to potential employers who may be interested in your application), where applicable, including to third countries that may not have sufficient protection for personal data. Each time your personal data are transmitted, we ensure all legal requirements are met and, particularly, that any necessary contractual agreements have been concluded by us with these clients in advance to ensure the legally required level of protection when processing your personal data.

You are hereby expressly informed that you are not obliged to agree to the processing of the data and, provided you give your consent, you have scope to revoke said consent at any time with effect for the future, with respect to the contact data specified in section 1 below. Please note that if you decide not to accord a declaration of consent to Signium to process your personal data, it will not be possible to include you in Signium's personnel consulting process, as we can only refer you to clients if Signium has scope to process your personal data and, where applicable, forward the same to clients.

The following section explains how and to what extent we collect, process and use personal data about you. We therefore ask you to read the following explanations carefully, since you have expressly indicated agreement by clicking on the declaration of consent below.

1.Name and contact details of the data controller

The party responsible for processing your candidate information according to Art. 4 Par. 7 General Data Protection Regulation (GDPR):

2. Collection and storage of personal data as well as the type and purpose of their use

To facilitate our consulting services in personnel consulting and executive search fields, Signium personal data is provided by you, accrued during the performance of our services or collected and processed by ourselves.

The data concerned includes the following particularly:

Candidate's data (e.g. name, date of birth, marital status, private contact details, address, salary,
period of notice), job title and name of current employer, CV and the information contained therein
such as vocational training and work experience, data from social networks or publicly available
online sources.

This data is collected:

solely for the purpose of assessing the suitability of candidates for client positions and subsequent
submission to Signium clients as potential new employers of candidates as part of executing the
application process.

The legal basis for collecting the relevant data is the consent given here by the candidates (Art. 6 para. 1 sentence 1 lit. a GDPR). This consent is given by clicking on the "I agree to the processing of my personal data described above, particularly also the aforementioned storage and forwarding" and confirmation by clicking the "OK" button. Specification of the data is voluntary: you alone determine which personal data you actively transmit to Signium. The more information is provided, the better able we are to assess the suitability of candidates for client positions and handle their subsequent placement. To evaluate the candidate's professional profile, it may be necessary, in addition to the data you actively submit to Signium, to collect information about the candidate via social media or publicly accessible online sources that are further relevant when evaluating the candidate.

This storage is conducted in the interests of the candidates as part of a long-term cooperation, which also extends beyond the one-off placement. You can revoke your consent at any time under the contact data stated under item 1 above and/or under the same signature to request the deletion of your candidate information, which will then be implemented immediately, unless legal retention obligations make this impossible.

By submitting the following declaration of consent, you expressly agree that we will store your candidate information until it is successfully placed with a client.

3. Disclosure of information

The data will initially only be processed within Signium International GmbH Angela Westdorf in Cologne. It is also possible that the data may also be passed on to other Signium locations within Germany (Düsseldorf, Frankfurt, Munich and Wiesbaden). The main purpose here is to boost the opportunity to successfully place candidates. Personal data is only transferred to clients if a candidate is suitable for a client position or fits the client's requirement profile.

By submitting the declaration of consent below, you expressly agree that candidate information will be passed on to clients at Signium locations in Germany for the purpose of increasing the chances of placement.

In this case, the clients receive a confidential report on the candidate. The confidential report contains all relevant information that the client needs about the candidate to assess whether or not the candidate is suitable for a position. Successful placement is contingent on disclosing such data to the clients. This means that, if you do not submit your declaration of consent here, it will not be possible to arrange a placement. Similarly, if you revoke the declaration of consent later with effect for the future, no future placement will be possible.

The legal basis for the transfer is the consent of the candidates (Art. 6 para. 1 sentence 1 lit. a GDPR).

It is expressly pointed out that it may be possible that database servers of clients to which candidates' information is sent by Signium in the course of its consulting services may be located in third countries outside the European Economic Area (EEA), in which the EU Commission has not confirmed an appropriate level of data protection.

By submitting the following declaration of consent, you expressly agree that the relevant candidate information may also be disclosed to appropriate recipients.

4. Rights of parties concerned

You have the right to:

• Information about your personal data processed by us (Art. 15 GDPR);

• Correction of incorrect or complete personal data stored by us (Art. 16 GDPR);

• Deletion of personal data stored with us, where said data are not (any longer) necessary

for the processing and said action does not contravene any legal regulations (Art. 17 GDPR);

• Limitation of the processing of your personal data (Art. 18 GDPR);

• Receipt of your provided data or transmission to another person responsible (Art. 20 GDPR);

• Revocation of your consent (Art. 7 para. 3 GDPR) and

• Complaint to the competent supervisory authority (Art. 77 GDPR).

For such requests and/or notifications, we are available under the contact data indicated under item 1 above.

As a general rule, information is always transmitted electronically (by email). If you use this option, the email address (both sender and recipient) will only be used to provide information and for documentation purposes.

5. Right to object

If your personal data are processed on the basis of public interest or legitimate interests, pursuant to Art. 6 para. 1 sentence 1 lit. e, f GDPR, you have the right to object to the processing of your personal data pursuant to Art. 21 GDPR, provided that there are reasons for this attributable to your particular circumstances. If you exercise your right of objection accordingly, we ask you to explain the reasons why we should refrain from processing your personal data. If your objection is justified, we will stop or adjust the data processing or inform you of compelling reasons for not acceding to said request, whereupon we will resume the processing.

6. Deletion

We delete your personal data as soon as they are no longer required for the corresponding purposes. This basically equates to deletion after successful placement with a client, unless we still have your irrevocable declaration of consent that we may continue to process your personal data after successful placement to remain in contact with you and/or to be able to consider you in future search mandates, and unless there are legal retention obligations. We are legally obliged to store certain data on the basis of proof and storage obligations, for example from the German Commercial Code, the Tax Code or the Money Laundering Act. These storage durations last up to ten years. There may also be circumstances whereby personal data is stored for the period during which claims can be made against us (e. g. the statutory limitation period of three or thirty years). If we are not obliged to store personal data and the data is no longer necessary to protect or defend against claims, it will be deleted immediately.
